How the Highway Beautification Act of 1965 Affects Billboard Advertising

No matter what highway or interstate you travel on in the United States, you are bound to see billboards along the way. However, do you know the regulations and rules that are associated with the placement of these billboards? Although originally crafted to provide billboard control provisions that would, in time, eradicate billboards, the Highway Beautification Act of 1965 requires states to maintain “effective control” of outdoor advertising.

The state of Oklahoma officially entered into this agreement in April of 1972 in conjunction with the Secretary of Transportation to make provision for compliance. This effectively set out new guidelines that billboard advertising providers would need to conform with. In practice, the Highway Beautification Act of 1965 mandates that all billboards must be erected and maintained within 600 feet of the nearest edge of the interstate and other primary systems. However, the determined size, lighting and spacing of billboards are defined by the state.

The original intent of this agreement was to preserve the natural Any state that does not remain in compliance with these regulations will be ineligible to receive the full amount of Federal-aid highway funds that have been apportioned to them. This often is the driving factor for compliance with state-mandated rules; however, they are generally fairly loose rules to ensure the maximum amount of funds are procured with minimal change.
